Elon Musk Drops Lawsuit Against OpenAI and CEO Sam Altman

Published June 11, 2024

In an unexpected legal turn, Elon Musk withdrew a lawsuit filed against OpenAI, the artificial intelligence research company he co-founded, and its current CEO, Sam Altman. The lawsuit, which had been initiated in February, accused OpenAI of straying from its mission to develop AI for the good of humanity rather than profit.

Legal Filing Without Explanation

Musk's lawyers submitted a request to the San Francisco Superior Court to have the case dismissed. This request came without any disclosed reason, leaving the details surrounding the decision a matter of speculation. The initial lawsuit filing had stimulated considerable attention, with Musk and OpenIA previously sharing a vision for safe and beneficial AI development.

Court Proceedings Halted

The case was gearing up for a procedural event, as a judge from the same court was ready to address OpenAI's aim to have the lawsuit dismissed at a hearing set for the following Wednesday. Yet, the preparations for this hearing became unnecessary following Musk's decision to drop the case.

While the reasons for dismissing the lawsuit remain private, it is worth noting that the legal action was dismissed without prejudice. This legal term means that Musk retains the option to reopen the lawsuit at a later time, should he choose to do so.

OpenAI had previously criticized the lawsuit for being founded on 'convoluted' and 'often incoherent' premises. Despite these accusations, neither OpenAI nor Musk's attorney immediately offered public comments regarding the dismissal.
